Acceptance of Terms
By accessing or using Tour Assists (our web platform) or Explorata (our mobile application) (collectively, the "Service"), operated by Intellisr ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and continued use of the Service after changes constitutes acceptance of the revised terms. We will notify users of significant changes via email or in-app notification.
1. Usage Terms
You agree to use Tour Assists and Explorata only for lawful purposes and in accordance with these terms. Specifically, you agree to:
- Provide accurate and truthful information when creating your account and setting travel preferences. Falsifying information may result in suboptimal recommendations and is a violation of these terms.
- Use the Service only for personal travel planning purposes. Commercial use, redistribution of AI-generated content, or automated access to our platform is prohibited without explicit written consent.
- Not attempt to reverse engineer, decompile, or disassemble any part of the Service, including our AI algorithms and recommendation engine that power the Tour Assists and Explorata experience.
- Not interfere with or disrupt the Service, servers, or networks connected to the Service, including by uploading viruses, malware, or engaging in denial-of-service attacks.
- Respect the intellectual property rights of Intellisr and our content partners. Travel recommendations, itinerary designs, and platform features are protected by applicable intellectual property laws.
- Not use the Service in any manner that could damage, disable, overburden, or impair the platform or interfere with any other party's use and enjoyment of the Service.
2. Account Registration
To access certain features of Tour Assists or Explorata, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate accounts that violate these terms, engage in suspicious activity, or remain inactive for extended periods. You must be at least 18 years old to create an account and use our premium services.
3. Payment Policy
Subscription Plans
Tour Assists offers free and paid subscription plans. Free plan features are available at no cost. Standard and Premium plans require payment as described on our pricing page at the time of subscription. Prices are subject to change with 30 days advance notice to existing subscribers. Your continued use after a price change constitutes acceptance of the new pricing.
Billing & Renewal
Subscriptions are billed per trip or on a recurring basis depending on the plan selected. Payment is processed through our secure third-party payment providers. By subscribing, you authorize us to charge the applicable fees to your selected payment method. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. You may cancel your subscription at any time through your account settings or by contacting our support team.
Refunds
We offer a 7-day money-back guarantee for new subscribers. If you are not satisfied with our premium service, you may request a full refund within 7 days of your initial purchase. Refund requests for usage beyond the 7-day period are evaluated on a case-by-case basis. Refunds for partially used subscriptions are prorated based on the remaining unused time.
4. AI-Powered Services
Tour Assists and Explorata use artificial intelligence to generate travel recommendations, itineraries, and real-time guidance. While we strive for accuracy, AI-generated content is provided for informational and planning purposes only. Travel conditions, prices, availability, and local regulations may change without notice. We recommend verifying critical information (visas, health requirements, safety conditions) with official sources before and during your trip. Intellisr is not responsible for decisions made based solely on AI recommendations, and travelers should exercise their own judgment in all travel-related matters.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Intellisr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, travel bookings, or other intangible losses. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to Intellisr in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
6. Governing Law
These Terms and Conditions are governed by the laws of the Democratic Socialist Republic of Sri Lanka, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved through arbitration in Colombo, Sri Lanka, in accordance with the Arbitration Act No. 11 of 1995. You consent to the exclusive jurisdiction of the courts of Sri Lanka for any matters not subject to arbitration.
